New Export Technology Controls Announced

When utilizing a Free Trade Agreement, Importers must ensure that their imported products can be substantiated with sufficient manufacturing records and country of origin backup.

U.S. Customs, through a CF 28 - Request for Information, will require an Importer to substantiate their claim. 

The Commerce Department's Bureau of Industry and Security (BIS) is implementing new controls on certain technology used in the gas turbine and semiconductor industries.
Specifically, the four technologies covered by the new controls:
  • Gallium Oxide (Ga2O3) and diamond are two substrates of ultra-wide bandgap semiconductors that allow them to work under more severe conditions such as higher voltages or higher temperatures; 
  • Electronic Computer-Aided Design (ECAD) software is specially designed for the development of integrated circuits with a "Gate-All-Around Field-Effect Transistor (GAAFET) structure"; and
  • Pressure Gain Combustion (PGC) technology for the production and development of gas turbine engine components or systems
These controls take effect on August 15th, 2022, except for Export Control Classification Number (ECCN) 3D006 for Software for ECAD for the development of Integrated Circuits (ICs) with GAAFET, which is effective October 14th, 2022. Anyone in these industries should become familiar with the new BIS regulations and apply for the proper licenses for exporting.
