Reciprocal Tariffs Have a New List of Exempt HTSUS Classifications

On September 05, 2025, the White House released an Executive Order, Modifying the Scope of Reciprocal Tariffs and Establishing Procedures for Implementing Trade and Security Agreements, that amended Annex II, a list of Harmonized Tariff Schedule of the United States numbers that are exempt from the Reciprocal Tariffs. The changes include the addition of 39 subheadings and the removal of 8 numbers. The change is effective September 8, 2025.

An Importer may apply an exemption to the reciprocal tariffs on their customs entry by reporting HTSUS 9903.01.32 for products properly classified in the heading and subheadings of the HTSUS that are identified in Annex II.

Effective Date

The changes are effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on September 8, 2025.
