Customs Clarifies ‘In-Transit’ Exemption to Reciprocal Tariffs

U.S. Customs and Border Protection (CBP) released an important FAQ on the in-transit exemption to reciprocal tariffs. CBP clarifies the in-transit exemption only applies to shipments transiting by vessel to the U.S. The exemption does not apply to other modes of transportation such as air, rail, truck, etc. For example, an ocean container arriving in the U.S. by rail or truck through Canada or Mexico would not qualify for the exemption.

CBP is requesting entries transported other than by vessel that were filed using HTS 9903.01.28, to be corrected, as necessary, as soon as possible by filing a post summary correction.

The FAQ also includes a table that provides guidance for entries that qualify for the in-transit provision under the Reciprocal Tariffs.
