February 2023 Market Update
A train derailment in Ohio on Feb 3 caused disruptions to cargo transiting between the East Coast and Midwest. The latest update, cars have been cleared from the site with service restored. Delays persist of 24hrs between Cleveland and the Northeast via Pittsburgh, PA. due to residual congestion.
Overall, capacity can be found on both air and ocean modes with minimal backlogs mostly due to poor weather or holiday break. Rates continue to trend downward. This is quite the reversal of 2022 trends.
Meanwhile, on the warehouse front, space continues to be tricky to source in high-demand areas, with rates trending sky-high.
- Space has tightened up a bit into APAC destinations post-Chinese New Year but is expected to improve in the coming weeks.
- EU Import Control System 2 (ICS2) will be implemented as of March 1st
- Carriers report air exports from the U.S. are down. Airlines are not committing to long-term rates, preferring to use dynamic pricing based on flight/revenue.

A Norfolk Southern train derailment on Feb 3 in Ohio was causing disruption for containers moving through the area as efforts were put forth to restore service. Alternate routes continue to be used to minimize shipment delays. Transit time delays of at least 24 hours to the following routes:
- Chicago <>Northeast;
- Port of NewYork / New Jersey <> Cleveland/Detroit/Ohio Valley
- Kansas City/St. Louis<> Northeast
We still recommend booking early as possible and keeping in mind blank sailings may interrupt regular weekly services and space availability.

Airfreight to Brazil
When it comes to US-BR airfreight trends, January often “sets the tone” for how Q1-Q2 will manifest. Particularly during the first and last 2 weeks as many US shippers/suppliers are pushing orders for project inceptions (or previous year’s project completions). Taking that into consideration, 2023 is off to a good start.
COVID-19 certainly brought with it reductions to flight options, which in turn, resulted in limited capacity and peak demand for space. There has been a gradual increase during post-COVID years which has helped reduce the demand and mitigate the extremely high spike in costs (which were realized during the pandemic).
New flight options have also allowed for allocating space amongst several airlines, rather than depending on 1 or 2 incumbent carriers. Though many airlines are pushing “Promotional Rates” to lure new business to fill the space, we remain steadfast to the carriers who proved to be most dependable throughout the strenuous times.
It is a well-known fact that exports to Brazil can prove to be a challenging task due to the strict Brazilian Customs regulations and Airline/Ground Handling Agent requirements. Just to name a few;
Despite many of the above-mentioned ongoing challenges, we remain optimistic that 2023 will continue to bring further process improvements and mutual growth to the US-BR trade lanes. Holding a strong mentality of learning from previous “aberrations” and pushing towards positive future “residuals.”
COVID-Related Medical Product Exclusions Extended Until May 15th
The U.S. Trade Representative (USTR) extended 81 COVID-related Section 301 China exclusions from expiring on February 28, 2023.
May 15, 2023, is the new expiration date for exclusions claimed under HTS 9903.88.66.
The 75-day extension allows the USTR time to consider whether the exclusions should be renewed past May 15.
Interested parties may comment on the further extension on the USTR Comments Portal between February 6 and March 7.

Section 301 Exclusions Extended Again – 9903.88.67
On December 16, 2022, the United States Trade Representative (USTR) announced a nine-month extension of 352 Section 301 China product exclusions. The exclusions were scheduled to expire on December 31, 2022.
The new expiration date is September 30, 2023.
These product exclusions can continue to be claimed under additional HTS 9903.88.67.
Additionally, the USTR is inviting interested persons to submit comments on whether certain tariff headings with a reinstated product exclusion should remain covered by the actions or be removed. Comments must be submitted on docket number USTR-2022-0014 through the online portal by January 17, 2023, at 11:59 p.m. EST.

In response to the United States Court of International Trade order (Slip Op. 22-130) and in cooperation with the National Marine Fisheries Service (NMFS), the U.S. Customs and Border Protection (CBP) is imposing immediate import restrictions on fish and fish products from the New Zealand inshore set net and trawl fisheries deployed in the range of the Maui dolphin, a marine mammal species endemic to the on the west coast of the North Island.
Prohibited Fish & Fish Products
This action prohibits the importation into the United States from New Zealand of all snapper, tarakihi, spotted dogfish, trevally, warehou, hoki, barracouta, mullet, and gurnard fish and fish products harvested by set nets and trawls in the inshore fisheries of the west coast of New Zealand’s North Island within the Maui dolphin’s geographic range.
Certification of Admissibility
To effectuate the court order, snapper, tarakihi, spotted dogfish, trevally, warehou, hoki, barracouta, mullet, and gurnard fish and fish products imported into the United States under the nnruk2dev.wpengine.com/2022/12/import-restrictions-on-certain-new-zealand-fish-and-fish-products/#HTS">HTS codes listed below, caught with a set net or trawl within the Maui dolphin range, are prohibited from entry into the United States unless accompanied by Certification of Admissibility that the fish or fish products are not of the designated species, were derived from fisheries using other gear, or derived from fisheries operated in other areas.
NMFS has worked with the Government of New Zealand to establish Certification of Admissibility procedures and additional details on documenting inbound shipments have been published on the NMFS website listed below. Either the NMFS-issued Certification of Admissibility form (OMB Control # 0648-0651) or the New Zealand-issued form US350 Certification of Admissibility may be used to validate that the inbound shipment/consignment is not subject to the court-ordered trade restriction.
NMFS does not require that all data fields are completed on the New Zealand issued US350 form, provided there is sufficient information to determine that the consignment contains fish that are not subject to the embargo. For example, if the fish species in the consignment as identified on the New Zealand form US350 is not within the scope of the embargo, other data fields (e.g., fishing gear, vessel names) may indicate “not applicable”.
NMFS advises that U.S. importers consult with New Zealand exporters regarding the species in the consignment, the appropriate HTS code for U.S. entry filing, and the version of the form (U.S. or New Zealand) to be used to certify admissibility in response to the court order.
Authorized Vessels
For the purposes of enforcing the court-ordered ban, the west coast of North Island inshore set net and trawl fisheries are designated as vessels less than or equal to 46 meters length overall that are authorized for fishing by the government of New Zealand and that operate in Fishery Management Area 8 and Fishery Management Area 9. Postal Code for Chinese Origin Goods Requirement

Effective March 18th, 2023, U.S. Customs and Border Protection (CBP) will require a Chinese postal code data element declared as part of the Manufacturer Identification Number (MID) for goods made in China.
The new requirement is intended to provide early notification to importers that their goods may have been produced in the Xinjiang Uyghur Autonomous Region (XUAR). Goods produced in XUAR are subject to Uyghur Forced Labor Prevention Act (UFLPA) which automatically presumes the goods were made with forced labor.
A valid postal code will be required when the manufacturer's country of origin is reported as China.
Importers will be notified if:
All goods originating in XUAR are subject to detention upon arrival into the U.S.
Preparing for the New Requirement
Importers can prepare for the new requirement by verifying a valid Chinese postal code is included as part of the address listed on commercial documents for Chinese manufacturers and suppliers.
It depends. If the product is textile (19 CFR 102.23(a)) or has other agency requirements that mandate the actual manufacturer to be declared at time of entry, then the actual manufacturer name and address must be used. If no such requirement exists, then you may use the third-party seller or invoicing party as the manufacturer identifier.
Your customs broker will receive a warning message and should notify you about the rebuttable presumption established by UFLPA.
Importers may request an exception to the rebuttable presumption from CBP during a detention, after an exclusion, or during the seizure process as described in the UFLPA Operational Guidance for Importers on Page 9. Importers may also submit information that the UFLPA is not in fact applicable to the imports that have been detained, excluded, or seized.
Shipments flagged due to a postal code located in the XUAR will be detained by U.S. Customs.

The U.S. National Marine Fisheries Service (NMFS) Fisheries Certificate of Origin (NOAA Form 370) has been updated with a new expiration date of September 30, 2025.
Background: Under the Dolphin Protection Consumer Information Act (16 U.S.C. §1385), the U.S. National Marine Fisheries Service (NMFS) requires a Fisheries Certificate of Origin (NOAA Form 370) to be submitted to the CBP Automated Commercial Environment at the time of, or in advance of, importation of all frozen or processed tuna products. The Office of Management and Budget (OMB) Control Number for the Fisheries Certificate of Origin expired on July 31, 2022. NMFS provided revised versions every 30 days until OMB approved as stipulated under the Paperwork Reduction Act. OMB has approved a Fisheries Certificate of Origin (FCO) with an expiration date of September 30, 2025.

CIT Issues Response to Lawsuits Challenging List 3 & 4A
The Court of International Trade issued an opinion and order in response to over 3,000 lawsuits that challenged the U.S. Trade Representative (USTR) authority to impose Section 301 tariffs on List 3 and 4A. The court ruled against the plaintiffs who argued that the USTR could not impose Section 301 tariffs because the government was responding to retaliatory tariffs from China.
However, the court has sent the matter back to the USTR after ruling that the USTR failed to adequately respond to comments submitted in advance of the Section 301 tariffs. The tariffs will remain in place for now while the USTR reconsiders its actions pertaining to its failure to respond to comments. The USTR has until June 30th to respond to the court’s order.
On April 12, importers via their customs broker can begin requesting refunds on eligible customs entries and applying exclusions associated with HTS 9903.88.67. The extended exclusions are effective from Oct 12, 2021 - Dec 31, 2022.

March 2022 China Tariff Update and Will the Section 301 China Tariffs Start Expiring?
On July 6th, it will be four years since the implementation of Section 301 China tariffs.
The tariffs will automatically expire on their 4th birthday unless the U.S. Trade Representative (USTR) takes specific actions, including a review within 60 days of July 6th.
Of the four lists, List 1 (HTS 9903.88.01) would expire first on July 6th, followed by List 2 (HTS 9903.88.02) on August 23rd.
The USTR may ask for comments from the public on renewing the tariffs.

Firstly, I would like to express my gratitude for launching our new nnr Global Website and social media activities. This surely can be the platform where all nnr family members and our valued customers and associates will easily and widely communicate with each other.

nnr Global Logistics
Power with control
nnr manages shipments by Ocean freight from Asia to customers and distributors throughout Europe, supporting the management of inventory levels and warehouse capacity by utilising appropriate sailings. Dynamic supply includes drop-shipments into various destination ports.
Our particular challenge came in the shape of 3 containers, each loaded with heavy weight, Hazardous ‘Class 8’ batteries from Southeast Asia. The product was destined for continental Europe and concerns were rising over the tight lead-time to turn around this product to meet delivery deadlines. With this in mind, additional resources were planned to receive the containers in the UK at night, decant and re-label the product before morning, and be loaded onto outbound trucks.
nnr presented an alternative solution in view of the time constraints, being that the containers should terminate their ocean journey in Hamburg, releasing the cargo to our bonded warehouse facility. nnr would then decant and re-label the product in Germany for overland delivery by truck.
Whilst the arrangement seemed initially straightforward, the intricacies of the multiple labelling requirements soon became evident and the consequences for any non-compliance could lead to rejection of the cargo.
With the importance of the opportunity in mind, nnr sent staff from the UK to join the nnr Germany team to support the execution of the operation with great precision. Our teams worked through the evening to ensure the customers received the full quantity of pristinely labelled product on time. All parties were extremely satisfied and the dramatic effect for our customer is that it has enabled them to increase their orders with their customer in line with an expansion and profile drive in Europe.
Our team were thanked again for “nnr’s continual support, engagement and proactive approach; especially in more difficult times during which nnr continued to exceed expectation”.
Expansion with balance
2014 was an interesting year for nnr Global Logistics. The group has been organically growing globally for over 100 years which in itself is fairly unique in today’s world.
2014 produced record results for the group, achieved by providing outstanding service to customers and creating new value from a global logistics portfolio.
nnr in the United Kingdom enjoyed continued success with its own careful organic ‘expansion with balance’ strategy that also resulted in a record year for growth. The company’s progression in Contract Logistics is rapid but a natural complement to the previous core competences of international transportation by Air, Ocean, Road and Rail.
“We achieved UKWA membership, gained our Operators License and received ISO 9001, 14001 and AEO accreditation all in our first year. We achieved our objectives – and, as always, On Time and In Full”, said nnr’s Tim Dabbs, Head of Contract Logistics.
“We are proud to offer a site that operates to the highest standards and as we are now already nearing capacity, we are planning our next investment to facilitate our rapid expansion”.

Reversing ones fortunes
nnr provide a centralised programme that transports all components to London for cross-docking. This process enables singular customs clearance costs at the destination and benefits from the removal of minimum transportation charges for each individual unit. The real beauty of the operation is that each individual shipment is still billed and visible individually via nnr’s Internet Tracking facility by serial number and RMA (PO) number.
The program had proved successful in reducing transportation cost, communication cost and expensive Management Time for our customer. Whilst happy with the initial result, we felt latency remained in the supply chain and we assessed the removal of which, would result in better financial deliverables.
With the customers’ financial interests in mind, nnr put forward a change in process where we would use express truck services to transport the shipments to the European cross-dock and then retain the use of an economy-based consolidated air freight service to the final destination. This change was agreed and implemented had a dramatic effect on the overall transit time, delivering a consistent total Door to Door transit time average of 6 days.
This significant change enabled our customer to benefit from an outright transit time saving of 2 days per shipment. Whilst that may not sound significant to some, the impact resulted in a reduction of 600 ‘product in transit’ days per month and had the major and positive impact on inventory levels desired.
Not content with this and a part of our continuous improvement commitment to the customer, nnr sought to further fine-tune the process. Our intention was to deliver the absolute fastest ‘consolidated’ service to further negate the need for additional manufacturing and to further improve the inventory levels whilst improving the customers ‘order to cash’ ratios.
With this in mind we decided to enhance the service to its optimum, complementing the express truck routine into the cross-dock by utilising daily direct outbound flights direct to the final destination. The effect of this final improvement delivered an additional average saving in transit time of 2 days depending on the origin and destination.
In simple terms we have enabled our customer to avoid raw material cost and manufacturing costs, improve cash-flow and effectively manage optimized inventory levels.
Stand and deliver
Preliminary estimates on size were more than a little conservative! Initially our solution was based upon 18 tonnes and approximately 150 cubic metres of cargo. Almost one month later, we received a refined request for the same transaction which required confirmed pricing with transit time guarantees. This estimation stated more accurate particulars which projected ten times more weight and double the size at 180 tonnes at a whopping 260 cubic metres.
nnr’s dynamic packing and logistics solution was accepted and much careful planning ensued until the actual date of commencement a further month on. The planning included visits to the customer in Japan to agree the process and visits from the customer in Japan to consult with nnr regarding Customs, packaging and crucial safety aspects.
Operations commenced on Friday morning. nnr arranged cranes and lift-trucks to suit and the deployment of six 45-foot Tautliner vehicles with removable roofs to complete the task. The process included the unpacking of 90 metres of steel frame and 25 metres of steel bases ranging up to 11 metres long each.
The following day, [Saturday] our expert packing team arrived on site and worked through the evening to ensure we remained on course for a finish the following evening. On Sunday morning it became clear that some items, now packed, were even larger and heavier than originally estimated. nnr provided an additional vehicle to cater for the extra demand.
On Monday morning, senior management from both nnr and the customer attended the site to witness the loading and dispatch. The first item to move was the largest at 10 tonnes in one piece. All crates were then loaded in accordance to our Method Statement and Health and Safety guidelines. All 29 pieces were loaded by 5pm and the shipment departed, destined for the chosen airport of departure in continental Europe.
The schedule was to uplift the cargo daily, to synchronize with the build requirement at the destination. nnr remained in attendance throughout the 5 day period and all pieces arrived in Shanghai absolutely to schedule to give comfort to our customer and the engineers who had flown to China to build the stand.
A touch of glass
Our customers business had successfully deployed a promotional campaign in Australasia whereby retail outlets rewarded consumers with gifts based upon their purchasing ratios. The products were in extremely high demand and the logistics requirement was further stretched due to the additional quantities of ‘Gratis’ gifts required.
Our (soon to be) customer had planned on stock replenishment by ocean freight however the demand was too great and therefore we were asked to produce a solution by air freight.
The emergency shipment consisted of approximately 14 tonnes of glassware. Not ideal for transhipment but somewhat unavoidable due to the location at both origin and destination.
Our investigations began in France where the cargo was residing at the manufacturing facility. We could not obtain sufficient capacity or a suitable price for our customer by flying the shipment directly from France and therefore we searched for alternatives.
Our primary proposal became to transit the cargo via the UK where we had negotiated both capacity with a price that was preferable for the customer.
The following day, nnr arranged for five air-ride trucks to transport the goods from the manufacturing site in France to nnr in London Heathrow. Upon arrival at London Heathrow our team arranged for re-packing to ensure the shipment was suitably protected for carriage by air. Airline bookings were made spanning over 5 days and on each of those days nnr attended in the early hours to ensure the cargo was expedited safely.
Within seven days from the original notion, all cargo was safely delivered to the customer, some 12,000 miles away.
