301 China Tariffs Continue With No Change

On September 8, 2022, the U.S. Trade Representative (USTR) released an official notice that the Section 301 China tariffs will continue. 

The notice follows the first step in the statutory four-year review process, where the USTR provided the opportunity for representatives from domestic industries benefiting from the action to request the continuation of the tariffs.

USTR received a total of 434 requests for the continuation of both actions.

Accordingly, the actions have not terminated and will remain in effect, subject to possible further modifications, including any modifications resulting from the statutory four-year review. 

DATES:

The July 6, 2018 action (9903.88.01 [List 1]), as modified, did not terminate on July 6, 2022, and will remain in effect, subject to possible further modifications.

The August 23, 2018 action (9903.88.02 [List 2]), as modified, did not terminate on August 22, 2022, and will remain in effect, subject to possible modifications.

NEXT STEPS:

The USTR will conduct a review of the two actions.  USTR will publish a separate notice or notices describing the review process, which will include opening a docket for interested persons to submit comments on, among other matters:

  1. The effectiveness of the actions in achieving the objectives of the investigation,
  2. Other actions that could be taken, and
  3. The effects of such actions on the U.S. economy, including consumers.
